Terms and Conditions for Individual Members

These Terms and Conditions explain the basis on which Trauma Informed Law (“TiL”, “we”, “us” or “our”) provides access to the Vicarious Trauma Toolkit Hybrid Learning Hub (“the Hub”).

Please read them before purchasing a membership.

1. About the Hub

The Hub is an online learning and development programme designed to support individuals to understand and navigate the potential impact of working with trauma, distress and challenging experiences.

Your membership may include:

●      self-paced video content;

●      accompanying handouts and learning resources;

●      reflective exercises; and

●      access to live online Live Learning Labs and other live learning opportunities included within your membership.

The precise content and live programme available during your membership may change from time to time. We may update, improve or replace content where reasonably necessary, provided that we do not materially reduce the overall nature of the membership you have purchased.

The Hub is intended to provide an ongoing learning and reflective experience. It is not a professional qualification, accreditation or certification unless we expressly state otherwise.

2. Your membership

Your membership gives you a personal, non-transferable right to access the Hub for the membership period you have purchased.

Unless we tell you otherwise when you sign up, your membership period is 12 months. Your contract is formed when your purchase is accepted and your membership period begins on the date on which access to the Hub is first made available to you.

Your membership is for you alone.

You must not:

●      share your login details with anyone else;

●      allow anyone else to access the Hub using your account;

●      copy, reproduce or distribute our materials;

●      record or share Hub content or Live Learning Labs without our permission;

●      use our materials for commercial training or other purposes without our written permission;

●      download, reproduce, publish, upload, transmit, distribute, sell, licence, sub-licence or otherwise make Hub content available to another person, except where we expressly permit this;

●      remove or alter any copyright, trade mark or other proprietary notice;

●      use Hub content to create, deliver or support competing training, courses or other commercial products or services without our prior written permission;

●      circumvent or attempt to circumvent any technical access controls or security measures used by the Hub; or

●      use any Hub content or materials to train, develop, fine-tune or otherwise improve an artificial intelligence or machine learning system, or to create derivative content for such a purpose, without our prior written permission.

You may use the learning materials for your own personal learning and professional development during your membership period.

3. Price and payment

The price of your membership will be shown before you complete your purchase.

Payment must be made using the payment method made available at checkout.

Where you purchase membership before the Hub launch date, we will provide access from the launch date stated at the time of purchase. Where you purchase after launch, access will normally be provided following successful completion of your purchase and payment.

If payment is not received or is later reversed, we may suspend your access to the Hub until the matter is resolved.

Your membership period begins on the date specified at the point of purchase or, where applicable, the date on which access is first made available to you. Your membership does not automatically renew.

4. Consumer and professional purchases

These Terms apply to individuals purchasing membership directly.

If you are purchasing membership mainly for purposes relating to your business, trade or profession, some consumer rights may not apply to your purchase.

Nothing in these Terms is intended to remove or limit any rights that cannot legally be excluded.

5. Cancellation and refunds

If you are a consumer, you may have a legal right to cancel your purchase within a statutory cancellation period.

For most online consumer purchases, this will generally be a 14 day cancellation period. Please note that your statutory cancellation rights may be affected where the Hub includes digital content that you ask us to make available during that period, as explained below.

If you gain access to the Hub before the end of the statutory cancellation period, you will be required to give your express consent for the digital content to be supplied during that period and to acknowledge that, once supply begins, you will lose your statutory right to cancel the contract in relation to that digital content.

If you do not give the required consent and acknowledgement, we will not provide the digital content during the statutory cancellation period unless otherwise permitted by law.

Refunds are not ordinarily available once access to the Hub has begun. Any statutory rights you have in relation to cancellation, refunds or digital content that does not conform to the contract remain unaffected.

If you wish to exercise a statutory cancellation right, you can contact us using the details in section 15.

6. Renewal

Your membership will end automatically at the end of the 12-month membership period.

We may contact you before or after the end of your membership with information about renewal or other TiL services, subject to our applicable marketing preferences and legal requirements. Any renewal will require you to make a new purchase.

7. Live Learning Labs

Live Learning Labs are designed to provide an opportunity to explore and apply the learning from the Hub in a live, reflective environment.

They are educational and reflective spaces. They are not therapy, counselling, medical or mental health treatment, crisis support, legal advice or individual professional supervision.

All Learners attending the Live Learning Labs must agree to the Live Learning Lab Group Agreement.

You are always responsible for deciding what you do and do not wish to share. We encourage you to participate in a way that feels appropriate for you and to pause, step back or seek appropriate support where needed.

Places in live sessions may be subject to capacity and advance booking.

We may occasionally need to change the date, time, facilitator or format of a Live Learning Lab. Where possible, we will give reasonable notice and provide an alternative.

Live Learning Labs may be audio captured and/or transcribed by us using an AI-assisted meeting and transcription service, such as Fireflies, for the limited purposes described in our Data Protection Policy. This may include identifying recurring themes, questions, insights and learning arising across sessions and helping us prepare anonymised or aggregated reflective communications and learning resources.

We will tell participants before or at the start of a Live Learning Lab where such audio capture or transcription is being used. We will not use this process to assess, monitor or profile individual participants.

We will take reasonable steps to avoid including unnecessary personal, confidential or identifiable information in any wider communication or learning resource derived from a Live Learning Lab. We will not intentionally attribute a participant's contribution to them in such material without their permission.

You must not record, photograph, screen-capture or otherwise reproduce or share any part of a Live Learning Lab or another participant's contribution.

We may ask you to leave a Live Learning Lab if we reasonably consider that your conduct is disrupting the session, creating a risk to another participant or facilitator, or breaching the Live Learning Lab Group Agreement. If you are asked to leave a Live Learning Lab, you must comply promptly with that request, failing which we reserve the right to remove you from the online session.

8. Respect and confidentiality

We ask all participants to help create a respectful and supportive learning environment.

You must not:

●      harass, threaten or abuse another participant or facilitator;

●      share another participant's personal experiences or contributions outside the Live Learning Lab without their permission;

●      disclose confidential or identifiable information about clients, colleagues or other third parties; or

●      behave in a way that seriously disrupts the learning environment.

You should also avoid sharing information about clients, colleagues or other third parties in a Live Learning Lab unless it is necessary for the learning discussion and you have taken appropriate steps to anonymise the identities in question.

We ask participants to respect the confidentiality of the space, but we cannot guarantee that every participant will comply with this expectation.

We may ask you to leave a Live Learning Lab immediately where we reasonably consider this necessary to protect the safety, dignity, privacy or learning experience of other participants or facilitators. If you are asked to leave a Live Learning Lab, you must comply promptly with that request, failing which we reserve the right to remove you from the online session.

We may also suspend or terminate your Hub access where there has been a serious or repeated breach of these Terms, the Live Learning Lab Group Agreement or other applicable Hub requirements.

9. Important Note for Learners

Our Important Note for Learners forms part of your experience of the Hub, and we encourage you to refer to it before and during your participation.

The Hub provides education and professional development. It is not intended to diagnose, treat or provide therapy for any individual.

Some of the subject matter may feel challenging or personally relevant. You are encouraged to work at your own pace, make use of the resources provided and decide for yourself how you participate.

The Hub does not create a therapeutic, clinical, medical, legal or professional advisory relationship between you and TiL. If you need therapeutic, medical, mental health, emergency or other professional support, you should seek support from an appropriately qualified professional or relevant service.

Any examples, exercises, reflections or information provided through the Hub are for learning and reflection. They should not be treated as an assessment of your mental health, diagnosis, treatment recommendation or advice about a particular professional, legal or personal situation.

10. Intellectual property

All intellectual property rights in the Hub and its content, including videos, handouts, written materials, exercises, branding and other resources, belong to Trauma Informed Law.

We give you a limited, personal and non-transferable licence to use the Hub for your own learning and professional development during your membership period.

You do not acquire ownership of any of our content.

Except where expressly permitted by us, you may not copy, reproduce, adapt, translate, publish, distribute, sell, licence, sub-licence, commercially exploit or make available to any other person any Hub content or materials.

This includes using the Hub content as part of another course, training programme, consultancy service or other commercial offering.

You may download or retain materials only where the Hub expressly provides a download facility for that purpose.

Nothing in these Terms prevents you from making reasonable personal notes or applying learning from the Hub in your own professional practice, provided that you do not reproduce or distribute our content itself.

11. Data and privacy

We will process your personal information in accordance with our Data Protection Policy.

This may include information needed to:

●      create and manage your account;

●      provide access to the Hub;

●      manage payments and membership;

●      administer Live Learning Labs;

●      respond to questions or complaints; and

●      improve our services.

Our Data Protection Policy explains in more detail how we collect, use, disclose, retain and protect personal information, including information relating to Hub participation and Live Learning Labs. It also explains our use of third-party service providers and AI-assisted tools such as Fireflies where applicable.

We encourage you to read the Data Protection Policy before purchasing or participating in the Hub.

12. Our responsibility to you

We will take reasonable care and skill in providing the Hub.

However, we cannot guarantee that the Hub will always be uninterrupted or available on every device or internet connection.

The Hub depends in part on third-party platforms and services. We will take reasonable steps to maintain access to the Hub but are not responsible for interruptions, failures or changes to third-party services that are outside our reasonable control.

We may temporarily suspend access where reasonably necessary for maintenance, security, technical reasons or to protect the Hub and its users.

The Hub is intended as educational material. How you choose to apply what you learn is ultimately your responsibility.

We do not guarantee that the Hub will be suitable for every individual or every situation, or that applying the learning will produce a particular outcome.

The Hub is educational and reflective in nature and does not constitute legal, medical, psychological or therapeutic advice or professional supervision.

Subject to the following paragraph, our total liability arising from or in connection with the membership will not exceed the fees paid or payable by you for the membership in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.

13. Ending or suspending access

We may suspend or terminate your membership if:

●      you seriously or repeatedly breach these Terms;

●      you misuse or unlawfully share Hub content;

●      you seriously disrupt a Live Learning Lab or behave inappropriately towards others; or

●      payment due to us remains unpaid.

We may also suspend or terminate access where this is reasonably necessary to protect the security or integrity of the Hub or the safety, privacy or dignity of other participants.

Where reasonable, we will give you notice and an opportunity to resolve the issue before terminating your access.

Where access is suspended or terminated because of your breach of these Terms, you must stop using the Hub and its content immediately and must not retain, share or continue to use materials accessed through the Hub except where required by law.

Termination or expiry of your membership does not affect any rights or obligations which are intended to continue after the membership ends, including provisions relating to intellectual property, confidentiality, liability and use of Hub materials.

14. Changes to these Terms

We may update these Terms from time to time.

If we make a significant change that materially affects your membership, we will take reasonable steps to let you know.

The version of the Terms in force when you purchase your membership will normally apply to that membership period, unless a change is required by law or is necessary for security, operational or other important reasons.

16. General

These Terms do not affect any rights you have which cannot legally be excluded.

If any part of these Terms is found to be invalid or unenforceable, the rest will continue to apply.

These Terms are governed by the laws of England and Wales, unless applicable law requires otherwise. If you are a consumer, nothing in these Terms affects any mandatory rights you have under the law applicable to you, including any right to bring proceedings in the courts available to you under applicable consumer law.

We may not transfer our rights or obligations under these Terms in a way that would materially reduce your rights without your consent, except where permitted by law as part of a genuine business sale, merger, restructuring or transfer of the business.

No failure by us to enforce a provision of these Terms will amount to a waiver of our right to enforce it later.

By purchasing or accessing the Hub, you agree to these Terms and Conditions.
